• Ocean Container Planner: Optimizes container utilization

These tools are provided for informational and estimation purposes only and should not be relied upon as the sole basis for shipping decisions.

3. Critical Disclaimer of Warranties

3.1 No Carrier Authority

CargoTools.online is not a licensed freight carrier, broker, or forwarder. We do not transport goods, arrange shipments, or have any authority to determine freight classifications or rates.

3.2 Carrier Has Final Authority

The final determination of:

• Freight Class (NMFC classification)
• PCF Density
• Dimensional Weight
• Billable Weight
• Shipping Charges
• Accessorial Fees

...is made solely by your freight carrier (e.g., FedEx, UPS, XPO Logistics, TForce Freight, Estes Express, Old Dominion, R+L Carriers, etc.) at the time of shipment processing, weighing, and dimensioning.

3.3 Variations and Discrepancies

Carrier measurements may differ from your calculations due to:

• Different weighing equipment calibration
• Different laser dimensioning systems
• Different rounding rules and methodologies
• Carrier-specific classification rules
• Measurement of packaging materials and overhang
• Human or equipment error

3.4 "AS-IS" Provision

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CARGOTOOLS.ONLINE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED THEREIN.

• Direct damages: Including but not limited to carrier re-class fees, re-weigh fees, inspection charges, or overpayment on freight bills
• Indirect damages: Loss of business, loss of profits, loss of revenue, or loss of anticipated savings
• Consequential damages: Delivery delays, shipment rejections, or customer dissatisfaction
• Incidental damages: Cost of substitute services or procurement of alternative shipping
• Special damages: Damage to reputation or business relationships
• Exemplary or punitive damages: Of any kind whatsoever

4.2 Specific Exclusions

We are specifically NOT liable for:

• Carrier Fees: Any fees, surcharges, or penalties imposed by freight carriers including re-classification fees, re-weigh fees, dimensional adjustment fees, over-length charges, inspection fees, or detention charges
• Calculation Errors: Any errors, inaccuracies, or omissions in our freight class calculations, PCF density calculations, dimensional weight calculations, or any other calculator outputs
• Data Loss: Loss of calculation history stored in your browser's local storage
• Service Interruption: Temporary or permanent unavailability of the Service
• Third-Party Actions: Actions or omissions by freight carriers, brokers, or other third parties

4.3 User Responsibility

YOU ARE SOLELY RESPONSIBLE FOR:

• Verifying all calculations with your freight carrier before shipping
• Understanding your carrier's specific classification and rating rules
• Ensuring accurate measurement and weighing of your shipments
• Compliance with all applicable shipping regulations and carrier tariffs
• Any costs, fees, or charges resulting from shipment of goods

5. User Conduct and Acceptable Use

You agree NOT to:

• Misuse the Service: Use the Service for any unlawful purpose or in violation of these Terms
• Automated Access: Use bots, scrapers, or automated tools to access the Service without prior written permission
• Overload Systems: Attempt to overload, crash, or impair the Service's infrastructure
• Reverse Engineering: Attempt to reverse engineer, decompile, or extract source code from the Service
• Intellectual Property Violation: Copy, reproduce, or distribute our content without permission
• False Information: Submit false, misleading, or inaccurate information

Please note that calculation data (dimensions, weights, etc.) is processed entirely client-side in your browser and is NOT transmitted to our servers for storage.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that CargoTools.online shall not be responsible or liable for any damage or loss caused by use of or reliance on any such content, goods, or services available through any third-party websites or services.

9. Modifications to Service and Terms

9.1 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Ontario, Canada, and you hereby consent to the personal jurisdiction and venue of such courts.

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced with a valid, enforceable provision that most closely matches the intent of the original provision.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CargoTools.online regarding the use of the Service and supersede all prior and contemporaneous written or oral agreements between you and CargoTools.online.
